These Terms of Service (the "Terms") govern your access to and use of LUMANIskin.com and any related pages, content, features, purchases, and services operated by LUMANI SKIN (collectively, the "Site"). In these Terms, "LUMANI," "we," "us," and "our" refer to LUMANI SKIN, and "you" refers to each Site visitor or customer.
Please read these Terms carefully. By accessing the Site, creating an account, or placing an order, you agree to these Terms and to any policies linked or incorporated into them. If you do not agree, do not use the Site.
Acceptance and Eligibility
You must be at least the age of majority in your place of residence and legally capable of entering into a binding agreement to make a purchase. If you use the Site on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
You may not use the Site or purchase products for an unlawful or unauthorized purpose. You are responsible for complying with laws that apply to your access, purchase, possession, resale, and use of our products.
Our Online Store
The Site is hosted using third-party commerce technology, including Shopify. Those providers supply infrastructure that allows us to offer products and process transactions. Your use of third-party payment, shipping, analytics, or other services may also be subject to the provider's applicable terms.
We may update, suspend, withdraw, or restrict any part of the Site at any time. We do not guarantee that every feature, product, or service will always be available or error-free.
Products and Availability
Product descriptions, images, dimensions, colors, packaging, ingredients, features, and other details are provided for general information. We make reasonable efforts to display them accurately, but screens, photography, manufacturing updates, natural ingredient variation, and packaging changes may cause differences. The product and packaging you receive control where they differ from illustrative Site content, except where applicable law provides otherwise.
All products are subject to availability. We may limit quantities, discontinue products, refuse sales to dealers or resellers, and correct errors in product information or availability. Quantity limits or order minimums shown on a product page or at checkout form part of your order.
Cosmetic Use, Ingredients, and Allergens
LUMANI skincare products are cosmetics intended for external cosmetic use only. They are not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition. Site content is for general educational and informational purposes and is not medical advice. Individual results vary.
Before purchasing or using LUMANI ELIXIR N°44 or another LUMANI skincare product, review the full ingredient list made available on the Site and at checkout, and review the ingredient list and directions on the product packaging when it arrives. Do not use a product if you know or suspect that you are allergic or sensitive to any ingredient. Ingredient lists and formulations may be updated; the label on the product received is the most current source. If the online and package ingredient lists appear inconsistent, do not use the product and contact support@lumaniskin.com.
Patch-test skincare products before full use when appropriate, use products only as directed, avoid contact with the eyes unless the directions expressly allow it, and keep products out of reach of children. Discontinue use if irritation or an adverse reaction occurs. Seek advice from a qualified healthcare professional if you have allergies, sensitivities, a medical condition, are pregnant or nursing, take medication that may affect your skin, or have questions about whether a product is appropriate for you.
Product testimonials and before-and-after materials describe individual experiences and do not guarantee the same or any particular result.
Accounts
If you create an account, you must provide accurate, current information and protect your credentials. You are responsible for activity under your account unless prohibited by law. Notify us promptly at support@lumaniskin.com if you believe your account or payment information has been accessed without authorization.
We may suspend or terminate an account when reasonably necessary to protect the Site, customers, or LUMANI; investigate fraud or misuse; enforce these Terms; or comply with law.
Orders and Acceptance
An order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily mean we have accepted the order. We may accept an order by sending a shipment confirmation or otherwise beginning fulfillment.
We may reject, limit, or cancel an order before shipment for legitimate reasons, including suspected fraud, unauthorized resale, payment failure, inventory unavailability, pricing or description errors, shipping restrictions, or violations of these Terms. If we cancel after payment, we will refund the amount charged for the canceled items.
You are responsible for confirming the products, quantities, subscription status, shipping address, and billing information before submitting an order. Contact us promptly if you identify an error. We cannot guarantee that an order can be changed or canceled after processing begins.
Prices, Taxes, and Payment
Prices are displayed in U.S. dollars unless stated otherwise. Prices, discounts, and promotions may change without notice, but changes will not affect an order already accepted except as permitted by law. Shipping charges, taxes, duties, and other applicable amounts are shown at checkout when available.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment providers to charge all amounts shown at checkout. We may use account updater services made available by payment networks. You remain responsible for amounts due if a payment is reversed, declined, or disputed without a valid basis.
Subscribe & Save and Automatic Renewals
This section applies whenever you select a subscription or other recurring purchase option, including Subscribe & Save.
Clear checkout terms. Before you enroll, the product page or checkout will disclose the product, recurring price, delivery and billing frequency, any minimum purchase obligation, and how to cancel. Taxes and shipping may be added as disclosed at checkout.
Automatic renewal. Your subscription continues and your selected payment method will be charged at the frequency shown at checkout until you cancel. You authorize these recurring charges by affirmatively selecting the subscription option and completing checkout.
Confirmation. We will provide a retainable confirmation of the subscription terms and cancellation method. Keep that confirmation for your records.
First-shipment sculpting tool. An eligible new Subscribe & Save enrollment for LUMANI ELIXIR N°44 includes one complimentary LUMANI Sculpting Gua Sha with the first subscription shipment only, unless checkout expressly states otherwise. The tool is not included with renewal shipments. Canceling and later restarting a subscription does not guarantee another complimentary tool.
Cancellation. You may cancel future renewals at any time through the online cancellation control in your customer or subscription account, through a direct cancellation link provided in a subscription communication, or by emailing support@lumaniskin.com. Online cancellation will be available immediately after any reasonable authentication needed to protect your account. Email requests will be processed promptly. Cancel before the next scheduled charge to prevent the next order from processing.
Changes, skips, and processed orders. If your subscription portal permits, you may update payment or shipping information, change the delivery date or frequency, or skip a shipment before the order enters processing. Canceling does not retroactively cancel an order that has already been charged or processed. Returns or refunds for processed subscription orders are governed by the Returns and Refunds section below and applicable law.
Price or term changes. We will provide advance notice of a material change to your recurring price or other material subscription terms and explain how to cancel. We will also send renewal or continuation reminders when required by applicable law.
Failed payments. We may retry a declined recurring payment, ask you to update your payment method, or pause or cancel the subscription. We will not ship an unpaid order.
If the subscription terms shown at checkout conflict with this section, the checkout terms control for that subscription to the extent they are lawful and more specific.
Shipping and Delivery
Available destinations, shipping methods, charges, and estimated processing or delivery times are displayed at checkout or in the order confirmation. Delivery dates are estimates unless expressly identified as guaranteed. Carrier delays, weather, customs, high order volume, and events outside our reasonable control may affect delivery.
We will have a reasonable basis for any shipment timing we state. If no shipment time is stated, we will ship within the period required by applicable law. If we cannot ship within the promised or legally required period, we will notify you and offer the opportunity to agree to the delay or cancel the unshipped order for a prompt refund, as required by law.
You are responsible for providing a complete and accurate delivery address. Additional charges caused by an incorrect address, refusal, or failure to collect a package may be your responsibility to the extent permitted by law. Contact support@lumaniskin.com promptly about a package that arrives damaged, contains the wrong item, or appears lost. Responsibility for loss or damage will be allocated as required by applicable law.
Returns and Refunds
Unless a product page states that an item is final sale, you may request a return within 30 days after delivery. To be eligible for a preference-based return, a product must be unused, unopened, and in its original sealed packaging. For health, hygiene, and safety reasons, opened or used skincare products and used personal-care tools are not returnable solely because of preference, scent, texture, or individual results, except where applicable law requires otherwise.
If an item is defective, damaged in transit, or incorrect, contact support@lumaniskin.com within seven days after delivery and include the order number and reasonably requested photos. We will provide an appropriate remedy, which may include replacement, store credit, or refund, consistent with applicable law.
Contact us before mailing a return. Unauthorized returns may not be accepted. Unless the return results from our error or a defective or damaged item, you are responsible for return shipping and original shipping charges are not refundable. Approved refunds are issued to the original payment method after inspection. Financial institutions may take additional time to post a refund.
If you return an eligible first subscription shipment or a Sculpting Ritual bundle, all included components, including any complimentary or bundled sculpting tool, must be returned unused and in original condition. If an included component is not returned, we may deduct its disclosed retail value from the refund to the extent permitted by law.
Gift cards, promotional gifts not tied to a returned qualifying purchase, and wholesale orders are final sale unless defective, damaged, incorrect, or otherwise required by law. Any more specific return terms displayed on a product page or in a separately posted Refund Policy apply in addition to this section. Nothing in these Terms limits non-waivable consumer rights.
Promotions, Gifts, and Discount Codes
Promotions are subject to the terms presented with the offer, availability, and any stated expiration date, product restrictions, purchase threshold, or customer limit. Unless we say otherwise, offers cannot be combined, have no cash value, and may be changed or ended before an order is placed. We may refuse or reverse discounts obtained through error, abuse, duplication, or fraud.
Wholesale and Resale
Products designated for wholesale purchase are subject to the prices, case packs, minimum quantities, order increments, and other terms shown on the applicable listing, invoice, or checkout. Wholesale products are purchased for legitimate commercial resale only and may not be relabeled, adulterated, repackaged, or marketed using false, misleading, medical, or unauthorized claims.
Wholesale customers are responsible for complying with resale, tax, licensing, labeling, advertising, marketplace, and consumer-protection requirements. We may require resale documentation, limit sales channels, or establish separate wholesale terms. If separate signed wholesale terms conflict with these Terms, the signed wholesale terms control for that transaction.
Intellectual Property
The Site and its content, including the LUMANI name, logos, product names, packaging, photographs, graphics, videos, text, designs, and software, are owned by or licensed to LUMANI and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for personal, noncommercial shopping purposes.
You may not reproduce, distribute, modify, publish, sell, create derivative works from, frame, scrape, or commercially exploit Site content without our prior written permission. No license to any trademark, trade dress, or other intellectual property is granted except as expressly stated.
Reviews, Feedback, and Other Submissions
If you submit a review, photo, comment, idea, or other content, you represent that you have the necessary rights and that the submission is truthful, lawful, and does not infringe another person's rights. Do not submit confidential information or content containing unlawful, abusive, deceptive, or harmful material.
You retain ownership of your submission, but grant LUMANI a worldwide, nonexclusive, royalty-free, transferable, sublicensable license to host, use, reproduce, adapt, publish, translate, display, distribute, and create derivative works from it in connection with our business, marketing, products, and services, subject to applicable law and our Privacy Policy. We may remove or decline to use a submission, but are not obligated to monitor all submissions.
Prohibited Conduct
You may not use the Site to:
violate law, another person's rights, or these Terms;
submit false, deceptive, fraudulent, or malicious information;
introduce malware, harmful code, or automated traffic that burdens or disrupts the Site;
attempt unauthorized access to accounts, systems, data, or security features;
scrape, harvest, crawl, index, or extract Site content or customer information for commercial use without permission;
impersonate another person or misrepresent your identity or affiliation;
interfere with product availability, pricing, checkout, or another customer's use of the Site; or
use our products, content, or trademarks in connection with unlawful, misleading, or unauthorized claims.
We may investigate suspected violations and cooperate with lawful requests from courts, regulators, and law enforcement.
Third-Party Links and Services
The Site may link to or integrate with third-party websites, social platforms, payment services, subscription tools, or other services. We do not control and are not responsible for third-party content, availability, privacy, security, or practices. Your dealings with a third party are between you and that third party. Review the third party's terms and policies before using its services.
Privacy and Electronic Communications
Our collection and use of personal information are described in the Privacy Policy posted on the Site. By using the Site, you acknowledge that policy.
You agree that we may provide transaction notices, subscription confirmations, renewal notices, policy updates, and other legally required communications electronically, including by email or through your account. Marketing email or text messages are governed by the consent language presented when you enroll, and you may opt out using the method provided in those messages. Opting out of marketing does not stop non-marketing communications needed to service an order or subscription.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, SITE CONTENT, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." LUMANI DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT SITE CONTENT WILL ALWAYS BE COMPLETE OR CURRENT. PRODUCTS ARE SUBJECT TO ANY EXPRESS WARRANTY STATED ON THE PRODUCT PAGE OR PACKAGING AND TO RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMANI AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SITE, PRODUCTS, SERVICES, OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMANI'S TOTAL LIABILITY FOR A CLAIM ARISING OUT OF OR RELATED TO A PRODUCT, ORDER, THE SITE, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LUMANI FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
These limitations do not apply to liability that cannot lawfully be limited or excluded, which may include liability for fraud, willful misconduct, certain personal injuries, or violation of non-waivable consumer rights. Some jurisdictions do not allow certain limitations, so some of this section may not apply to you.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless LUMANI and its owners, officers, employees, contractors, affiliates, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful misuse of the Site or products, your violation of these Terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim results from LUMANI's own negligence, willful misconduct, or violation of law.
Governing Law and Disputes
These Terms and any dispute arising out of or relating to them, the Site, or a purchase are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except to the extent the law of your residence provides non-waivable consumer protections.
Before filing a formal claim, you and LUMANI agree to make a good-faith effort to resolve the dispute by written notice describing the issue and requested resolution. Send notices to support@lumaniskin.com and LUMANI SKIN, 6833 S Dayton St, Greenwood Village, CO 80112. If the dispute is not resolved within 30 days after receipt, either party may pursue available remedies.
Subject to any non-waivable right to bring a claim elsewhere, you consent to the personal jurisdiction of the state and federal courts located in Colorado, and venue in those courts where legally proper. These Terms do not require arbitration and do not waive any right to a jury trial or participation in a class action.
Changes to These Terms
We may update these Terms by posting a revised version with an updated date. Changes apply prospectively when posted unless a later date is stated. If a change materially affects an existing subscription, we will provide the notice and cancellation information required by law. Continued use of the Site after revised Terms take effect constitutes acceptance.
General Terms
If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. A waiver must be in writing and signed by LUMANI.
You may not assign these Terms without our written consent. We may assign them in connection with a business transaction or by operation of law. These Terms, incorporated policies, and applicable order or subscription terms are the entire agreement between you and LUMANI concerning their subject matter.
Headings are for convenience only. "Including" means "including without limitation." No provision will be interpreted against a party solely because that party drafted it.
